The Supreme Court of the United States has declined to hear an appeal of the lawsuit between Edwards Lifesciences (Irvine, California) and Medtronic (Minneapolis) over the firms' respective entries into the catheter-based aortic valve space, leaving Edwards in what might appears at first to be an enviable position where the U.S. market is concerned. The decision leaves in place a ruling by the Court of Appeals for the Federal Circuit that the CoreValve patent infringes the Sapien patent, but does not enjoin Medtronic from the manufacture of the CoreValve, although it appears that the district court is tasked with taking up the question of injunction per the remand ordered by the Federal Circuit.
